Birdwell California!, LLC DBA Birdwell Beach Britches (“Birdwell Beach Britches,” “we,” or “us”) respects your privacy. This Privacy Statement describes the types of information we may collect from you when you visit www.birdwell.com and all BIRDWELL BEACH BRITCHES-owned websites and domains, or use our other products and services that include an authorized link to this Privacy Statement (collectively, the “Website and Services”), how we use the information we collect, with whom we share it, and the choices we offer you regarding our collection and use of such information. If we add any new features or tools to our Website and Services, they will also be subject to this policy.

1. SHOPIFY

Our online store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products to you. Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted in accordance with the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

As described in the Shopify’s Privacy Statement, Shopify uses a number of machine learning algorithms and forms of automated decision-making that may involve Personal Information (defined below) about you. For example, Shopify uses automated decision-making to help us avoid fraudulent transactions. Most of these algorithms are not fully automated and include some human intervention (for example, customer risk and fraud scores are provided to us, and we must intentionally decide how to act on them). However, Shopify uses a small subset of fully automated fraud screening blacklists, which, if Shopify believes a transaction was made using stolen or fraudulent payment information, may stop one of our customers from completing a transaction—but only for a period of between a few hours and a few days.

2. INFORMATION WE COLLECT

When we use the term “Personal Information” in this policy, it means any information related to an identifiable individual. We may collect Personal Information about you from various sources, such as:

  • Directly from you when you access and use the Website and Services, such as when you register for an account, access certain features or content, or order or pay for products;
  • Social networks through which you may access the Website and Services or otherwise interact with us; and
  • Our related entities, affiliates, service providers, business partners, and other third parties.

The Personal Information we may collect about you may include, without limitation:

Instead of creating a separate log-in on our Website and Services to use to purchase products, manage your information and preferences, etc., we may enable you to log into the Website and Services using a social media account.
